Court Throws Out Affordable Housing Rules
Friday, January 26th, 2007Cause for celebration? Don’t break out your party favors and funny hats just yet.
In its decision, the court invalidated COAH’s methodology for determining municipal fair-share obligations. Among other rulings, it declared that COAH could not authorize municipalities to meet their housing obligations by requiring builders to provide affordable housing unless the builders were also granted compensating incentives
Basically, the court told the state we have 6 months to rewrite the rules. Needless to say, municipalities are going crazy over this, and affordable housing advocates are dancing in the streets.
